Privacy Policy

How Denton Med LLC, doing business as EVVPulse, collects, uses, shares, and protects information — including the mobile numbers and text messages at the center of our service.

1.Who we are

Denton Med LLC, a Texas limited liability company doing business as EVVPulse ("EVVPulse," "we," "us," "our"), operates the website at evvpulse.ai and the EVVPulse software platform.

EVVPulse helps home and community-based care agencies detect and resolve Electronic Visit Verification (EVV) exceptions. On behalf of those agencies, we send text messages to the caregivers they employ and process the replies.

2.Who this policy covers

This policy applies to two different groups of people, and it matters which one you are.

If you are…Then…
An agency — a home care agency that subscribes to EVVPulse, or a coordinator, administrator, or other staff member using it You are our customer. We collect account and usage information about you directly, described in Section 4.
A caregiver — an attendant or care worker who receives EVVPulse text messages You are not our customer. Your employer is. We process your information on your agency's instructions, as their service provider. Requests about your information generally go to your agency first — see Section 10.

This policy does not cover the practices of any agency that uses EVVPulse. Each agency maintains its own privacy practices governing its employees and clients.

3.Our role under HIPAA

Agencies that use EVVPulse are typically Covered Entities or Business Associates under the Health Insurance Portability and Accountability Act (HIPAA). EVVPulse acts as their Business Associate.

That means the agency — not EVVPulse — controls the protected health information (PHI) in the platform and determines how it may be used. We handle PHI only as permitted by our Business Associate Agreement with that agency, and only to provide the service. We do not use PHI for our own purposes, and we do not sell it.

We design our messages to minimize PHI exposure over SMS. Text messages we send reference visits by time rather than by client name or address wherever the service allows, with detail available behind an authenticated login instead.

5.Text messaging and your mobile number

The short version

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are never shared with any third party for any purpose unrelated to delivering the messages you agreed to receive.

How consent is obtained

Caregivers consent to receive text messages from their employing agency in writing, during employment onboarding or through a separate written authorization the agency provides. EVVPulse does not collect mobile numbers directly from the public and does not run any opt-in form on this website. The agency obtains and retains the record of consent; we store a copy so that the agency and, where required, mobile carriers can verify it.

What the messages are

Messages are operational, not marketing. They notify a caregiver of an EVV exception on one of their visits — a missing clock-in, a location mismatch, an incomplete record — and invite a structured reply so the exception can be corrected. We do not send promotional or advertising messages, and the platform may not be used to send them.

Who touches the messages

To deliver a text message we must pass your number and the message content to a messaging provider and to mobile carriers. That is what makes delivery possible; it is not sharing for marketing. Those providers are bound by contract to use the information only to deliver the message, and where PHI is involved, by a Business Associate Agreement.

6.How we use information

We do not sell personal information. We do not use caregiver information, agency data, or message content for advertising, and we do not disclose it to advertising networks or data brokers.

7.When we share information

We share information only in these circumstances:

Excluded from all sharing

Text messaging originator opt-in data and consent records are excluded from every category above except delivery and legal compliance. This information is not shared with any third party for any purpose unrelated to providing the messaging service you consented to, and is never shared, sold, rented, or transferred for marketing or promotional purposes — ours or anyone else's.

8.How long we keep information

When an agency's subscription ends, we return or delete its data in accordance with the Business Associate Agreement and our Terms of Service.

9.Security

We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information we handle. These include encryption of data in transit, access controls and authentication, and logging of access to protected information.

No system is perfectly secure. If a breach affecting protected health information occurs, we will notify the affected agency without unreasonable delay and in accordance with the HIPAA Breach Notification Rule and our Business Associate Agreement.

10.Your choices and rights

If you are a caregiver

Your employing agency controls your information in EVVPulse. To access, correct, or request deletion of your information, contact your agency — they are the appropriate party and can act on records we hold for them. You can stop text messages at any time by replying STOP, without contacting anyone.

If you contact us directly, we will refer your request to your agency and assist them in responding.

If you are an agency

You may access, correct, export, or request deletion of your account information and your agency's data by contacting us at privacy@evvpulse.ai. Rights and obligations regarding PHI are governed by our Business Associate Agreement.

Texas and other state privacy rights

Residents of states with comprehensive privacy laws may have rights to access, correct, delete, or obtain a copy of personal data, and to appeal a denied request. Protected health information handled under HIPAA is generally exempt from these laws. Where these rights apply, contact us at privacy@evvpulse.ai. We do not sell personal data or process it for targeted advertising, so there is nothing to opt out of in those categories.

11.Children

EVVPulse is a workforce tool for licensed care agencies and is not directed to children. We do not knowingly collect information from anyone under 18. Caregivers using the service are adults employed by our agency customers.

12.Changes to this policy

We may update this policy. When we do, we will revise the "Last updated" date above. If a change materially affects how we handle information, we will notify affected agencies directly. Continued use of the service after a change takes effect constitutes acceptance of the updated policy.
